For persons who may have been disabled from birth, or when a person has suffered a degenerative disease like dementia, obtaining a court order of incapacity may be needed to protect that person from themselves or other predatory individuals. That process is called guardianship. Timothy Kalamaros is experienced in petitioning for guardianship of persons who need this protection and for advising guardians on their fiduciary duties of management of and accounting for guardianship property. If a client is interested in obtaining guardianship on behalf of another person, please understand that expert witness evidence in the form of a physician’s sworn statement or testimony is generally required, to justify the limitation on that person’s liberties which may happen if a guardianship is ordered. Moreover, unlike many other probate court procedures, in-person appearance to give evidence is generally required as part of the initial court process.
